Latest Developments

1. In April 2026, cross-party members of the Romanian Parliament submitted a bill proposing to prohibit the use of e-cigarettes and heated tobacco devices in all enclosed public places. The bill proposes to redefine "smoking" to include the act of inhaling aerosols produced by heating or atomizing products containing tobacco, nicotine, or other substances intended for inhalation, with the exception of products for medical use.

Policy Trends

Continuous strengthening of minor protection: Law No. 64/2024 has significantly strengthened the provisions on the protection of minors, expanded the scope of products prohibited for sale to minors, prohibited use within educational institutions, and increased penalties for violations. The scope of the smoking ban in enclosed public places is proposed to be expanded: a legislator's proposal plans to include e-cigarettes and HNB in the indoor smoking ban, and the bill is currently under parliamentary review. The sponsor of the proposal stated that current law already prohibits the use of traditional cigarettes in enclosed places, but the tobacco industry circumvents the relevant provisions through electronic devices.

Taxation

E-liquid excise duty: 2026 increase to 1.03 Romanian Leu/mL (approx. 0.21 EUR/mL). As of 1 August 2025, excise duties on tobacco products increase by an average of approximately 10%. Romania has one of the highest vape taxes in the EU (adjusted for purchasing power parity). Excise duties on traditional cigarettes and e-liquid are expected to continue the staged increase trend in 2026. VAT: 19% (standard rate)

Sales Channel Restrictions

Sales of electronic cigarettes and refill containers to minors under 18 are prohibited. First offense: fine of approximately EUR 2,000 and suspension of business activity for 30 days; repeated offenses: fine of approximately EUR 4,000 and possible closure of the business. Sales of Vaping and Heating Products through vending machines are prohibited. Sales through easybox/locker devices (parcel pickup boxes) are prohibited. Cross-border distance sales to Romanian consumers are subject to indirect restrictions; Romanian retailers are also prohibited from making cross-border distance sales to consumers in EU Member States that have already prohibited such sales. Smoking and the use of any tobacco products, electronic cigarettes, and heating products are prohibited in all educational institutions.
