Latest Developments
Disposable e-cigarette ban officially takes effect: fully effective on June 18, 2025. As of July 1, 2025, plain packaging regulations are officially mandatory. In 2026, the e-cigarette flavor ban will be further strengthened, and the restriction on the e-cigarette flavor menthol will be banned before the end of 2026 (a ban was previously implemented but the menthol exemption is about to expire). The scope of smoking bans on school campuses/in public places will be expanded.
Policy Trends
Plans are to raise the legal age for purchasing e-cigarettes from 18 to 21 (legislation planned for 2026–2027), and to further tighten compliance for alternative products. After the EU revises the TPD, the Netherlands intends to adjust the nicotine limit, which may be lowered to 12mg/mL in 2025–2026, and simultaneously push this at the EU level.

Sales Channel Restrictions
After the 2025 disposable e-cigarette ban, vending machine sales in child-accessible settings are prohibited. E-cigarette sales are restricted to specialized e-cigarette shops and licensed tobacconists. Online sales have been essentially prohibited since July 2025 (in force under the 2024 Act). Cross-border sales require NVWA registration, with further tightening after 2026.

Flavour Restrictions
Since 2023, flavors other than tobacco and menthol have been banned. The menthol freeze period will end at the end of 2026 (a full ban on flavored products is planned). All other flavors are fully banned.
Product Specifications
Nicotine ≤20mg/mL, disposable/pod ≤2mL, refill container ≤10mL. Vitamins, caffeine, taurine, CMR substances, etc. are prohibited. Sweeteners (candy, etc.) and cooling agents (WS-23/WS-3, etc.) are prohibited. E-cigarette battery capacity ≤800mAh for disposable devices (only restricts disposable e-cigarettes).
Hardware Requirements
Child safety tamper-evident seal (compliant with NEN-EN ISO 8317). (Inverted) leak-proof test (NEN-EN 16156 standard); power limitation (closed systems ≤2mL as per TPD standard, open systems banned in 2025). Batteries certified under IEC 62133 and CE-RED. Mandatory removable battery design from 2026 (single-use devices banned in 2025). Device temperature limits: coil temperature 275°C (Ni200) or 315°C (titanium).
Packaging Requirements
Health warning: The nicotine warning statement "Dit product bevat nicotine, een zeer verslavende stof. Het gebruik ervan wordt afgeraden voor niet-rokers" covers 65% of the front and back surface area; the non-nicotine warning statement: "Dit product schaadt uw gezondheid.". Starting from July 2025, plain packaging (Pantone CMY+K 448C) shall be implemented, prohibiting brand logos, fruit/candy images, etc. Packaging must include a recycling mark.
Advertising Restrictions
Comprehensive ban on e-cigarette advertising (from July 1, 2024). Online, outdoor billboards, social media, etc. are prohibited. Only professional (B2B) publications and non-promotional in-store displays are allowed. From July 2025, all social platform advertising is blocked.
Notification Requirements
Must be notified via the RIVM/EU portal (EU-CEG) (6 months before placing on the market). Notification fee: EUR 44.85 per product (2024 price). Market data notifications (sales volume, consumer preferences, etc.) must be submitted before June 30 each year. An adverse health effects data collection system is also required.
