Latest Developments
By July 2025, ADM (Customs and Monopoly Bureau) has completed the enforcement whitelist for "prohibited candy/dessert flavor descriptions", and any product containing words such as "candy", "dessert", "ice cream" will be prohibited from import. The 2025 fiscal bill proposes an annual increase in the consumption tax on electronic cigarettes (0.16 euros/mL in 2025 → 0.19 euros/mL in 2026).
Policy Trends
The Italian Ministry of Health and ADM continue to tighten supervision and crack down severely on taste description violations. It is expected that the new bill will further restrict the sale of flavored electronic cigarettes, possibly implementing full flavor bans in sync with Germany, France, and other countries. The 2025 budget bill plans to ban the sale of disposable electronic cigarettes from 2026 onwards.
Taxation
Value added tax of 22%. Tariff of 3.7%. Stamp duty invoice: Products containing nicotine: 0.131303 euros/mL (tax included from Q4 2022 onwards). Nicotine free products: 0.087535 euros/mL. ADM regulations require retailers to update their licenses every two years. Importers are required to pay consumption tax. The 2025 fiscal bill proposes an electronic cigarette consumption tax of 0.16-0.19 euros/mL. It is planned to levy an environmental tax (1 euro/disposable device or 5 euros/device) and add a customs code 8517.79.00 to ADM.
Sales Channel Restrictions
Online sales are limited to specialty stores (e-cigarette shops, tobacco shops, pharmacies, Hukou sales) and tax warehouses only. The vending machine requires an age verification system (18+control for adult venues). Retailers must hold a valid two-year license issued by the local ADM (with over 50% of revenue coming from hardware and e-liquid). IT requires tax warehouse code display and traceable payment system.

Product Specifications
Nicotine ≤ 20mg/mL; Disposable ≤ 2mL; refill container ≤ 10mL (without nicotine refill and no capacity limit). Prohibit CMR substances and pigment additives. In November 2004, ISS guidelines set stricter heavy metal standards than the European Union, including formaldehyde ≤ 0.35mg/L and acrolein ≤ 0.081mg/L.
Hardware Requirements
Cigarette butts require food grade PCTG or 316L stainless steel. Anti leakage inverted for 24 hours without leakage. The battery complies with the IEC 62133-2 explosion-proof standard and is equipped with overcharge/overdischarge/short circuit protection. Child protection design (tested according to EN ISO 8317). The device needs to be equipped with an automatic locking function (power off after 5 minutes of idle). The label must be in Italian. ADM requires retailers to renew their licenses every two years.
Packaging Requirements
Health Warning: Nicotine containing products must have an Italian warning "Prodotto contentente nicotina..." covering 65% of the packaging area. Nicotine free products must have "Il prodoteto pu ò contenere sostanze pericolose per la salt." (may contain substances that are harmful to health). Packaging prohibits similar elements in food/cosmetics and economic incentives. The instruction manual must include usage/storage instructions, contraindications, etc. (in Italian).
