All electronic cigarette devices that are pre filled with e-liquid and cannot be refilled (whether rechargeable or not) are prohibited, excluding cartridges. Policy Trends
Moving towards stricter 'smoke-free generation' (2032) policies. Compulsory neutral packaging (already legislated), strict taste restrictions (to be promoted from 2026), and a complete ban on the sale of disposable electronic cigarettes. We plan to maintain the legal purchase age at 18 years old, but strengthen verification measures. Starting from July 1, 2025, the smoking ban in public places (including beaches, parks, etc.) will be expanded. Neutral packaging regulations have been implemented. Product Specifications
Nicotine concentration ≤ 20mg/mL; Disposable/smoke bomb ≤ 2mL; supplementary container ≤ 10mL; vitamins, caffeine/taurine, CMR substances, etc. are prohibited. Prohibition of Diacetyl (D é cret n ° 2023-456).
Hardware Requirements
Anti child/tamper proof packaging (CEN/ISO 8317:2015). Prevent damage and leakage. Electronic cigarette chargers must have the CE mark and comply with electromagnetic compatibility (Decree No. 2015-1084) and electrical material safety (Decree No. 2015-1083). The power limit of electronic cigarettes is 100W, and leakage prevention requires a 24-hour inverted test. The battery must comply with the IEC 62133-2 safety standard.
Packaging Requirements
Compulsory neutral packaging: Independent packaging and outer boxes (including nicotine free products) must implement "neutral, unified standard" packaging, consistent with the neutral packaging rules for cigarettes. Health Warning: Nicotine containing packaging must cover 65% of the area and include the French warning phrase "La nicotine cr é e une fort d é pending". Packaging prohibits fruit/food images and misleading claims. The instruction manual must include instructions for use, contraindications, etc. (in French). CLP regulations apply.
Advertising Restrictions
Prohibition of direct or indirect advertising, including online, outdoor, print, broadcast, promotion, sponsorship, etc. Allow internal display in specialty stores, professional publication advertisements (limited to 3 designated industry publications), and non promotional online displays.
Notification Requirements
Notify electronically through EU-CEG via ANSES (6 months prior to listing). The notification must include ingredients, emissions, toxicological data, nicotine dosage information, product component description, etc. Submit market data before March 31st each year. A system for collecting adverse health effects must be established. Notification fee is free.
