Taxation

Law No. 21,642 (published on January 4, 2024) legally equates ENDS/ENNDS and heated tobacco with tobacco products, applying a common regulatory regime, but electronic cigarettes have not yet been brought under the special tobacco excise tax in tandem. Current tax burden: electronic cigarettes are subject to 19% value-added tax (IVA) as general goods, and the special tobacco tax under Law No. 19,419 (the Tobacco Products Act) does not apply. Proposed tax increase (June 2026): the Ministry of Finance (Ministerio de Hacienda) and the Ministry of Health (MINSAL) are jointly drafting a legislative proposal to impose a special tax on electronic cigarettes and align their tax burden with traditional tobacco products; the proposal is being discussed in Congress as part of a tax reform package and has not yet taken effect. Product Specifications

The law defines the concepts of ENDS and ENNDS, and in principle these systems may only use aerosolized liquids. ENNDS for therapeutic purposes are explicitly recognized as electronic systems for the delivery or administration of therapeutically active ingredients (in liquid or herbal form), and their sale requires a medical prescription. The use of additives not previously notified to the Ministry of Health is prohibited, and additive concentrations must comply with concentration limits. Product specifications and ingredient concentration limits will be set under subsequent dedicated regulations of the Ministry of Health; there is currently no nationwide upper limit on nicotine concentration.

Notification Requirements

All companies with products subject to legal regulation must notify the Ministry of Health of the donations they make and the expenses incurred under agreements signed with public institutions, sports and community organizations, academic and cultural entities, and non-governmental organizations. They must annually notify the Ministry of Health of information on the composition, additives, and quality and quantity of ENDS/ENNDS and e-liquids. The use of additives without prior notification to the Ministry of Health is prohibited.
